How to Appeal the IRMAA Surchage for Medicare

This guide walks you through how to appeal an Income-Related Monthly Adjustment Amount (IRMAA) surcharge for Medicare Part B and D premiums.

Step 1: Understand the Appeal Process

- IRMAA is based on your income from two years ago.
- If you’ve experienced a qualifying “life-changing event,” such as retirement or work reduction, you may appeal using SSA Form SSA-44.

Step 2: Download and Complete Form SSA-44

- Download here: https://www.ssa.gov/forms/ssa-44.pdf
- Fill in personal information and check the life-changing event (e.g., “Work Stoppage” for retirement).

- Estimate your Modified Adjusted Gross Income (MAGI) for the current and next year.
- Include supporting documentation (retirement letter, recent tax return, employer notice).

Step 3: Submit the Form

- Submit by mail, in person at a local SSA office, or by calling SSA at 1-800-772-1213.

Step 4: Follow Up and Escalate if Needed

- If your appeal is denied, you may request a reconsideration, a hearing with OMHA, and appeal further if necessary.

Sample Statement

“To Whom It May Concern:

I am requesting a reduction in my IRMAA surcharge due to a recent life-changing event (e.g., retirement). My income has decreased significantly since the year used for the initial IRMAA determination. Attached are documents supporting my request. Thank you for your consideration.”
